PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. BY USING THIS WEBSITE AND/OR CREATING AN ACCOUNT ON THIS WEBSITE YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS WEB SITE OR CREATE AN ACCOUNT.
  1. Parties: The website you are accessing (the "Site") is hosted by RealtyPro Solutions, LLC ("Provider") on behalf of one of its real estate customers (the "Site Owner"). Certain features of the Site may require that you create an account before the features are available to you. Provider and Site Owner are independent contractors and are not partners or otherwise engaged in any joint venture in delivering the Site. Notwithstanding that fact, these Site Terms apply to both Provider and Site Owner and as such, any reference to "we", "us" or "our" herein will apply equally to both Provider and Site Owner.
  2. Account Security: You are responsible for maintaining the confidentiality and security of the username or password connected with your account, and you are responsible for the actions of anyone who logs in using your account.
  3. Limited Use: You agree not provide false or misleading information to the Site or to submit information under false pretenses. The listing data and property information provided in connection with the Site is for the personal, non-commercial use of consumers and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. You may not use the Site or any Site Materials for commercial purposes. You agree that you will not modify, copy,distribute, resell, transmit, display, perform, reproduce, publish, license, create derivative works from, frame in another Web page, use on any other web site or service any of the Site Materials. You will not use the Site or any of the Site Materials other than for its intended purpose or in any way that is unlawful, or harms Provider, Site Owner and/or their suppliers. No listing data may be harvested,scraped, collected, or made available to any other third party for any other reason without express written permission from the Provider and Site Owner.
  4. Privacy: We believe strongly in protecting your personal information, and in making sure you know how that information will be used. Any information you enter into an inquiry form or a feature designed to work with your account will be safeguarded by the Provider and will only be made available to you and to the Site Owner (including any real estate agents and/or employees affiliated with the Site Owner) for the intended purpose of providing you with real estate related information and services.
  5. Consent to Communications: By creating an account (and/or by filling out any forms on the site), you acknowledge that you may or may not be contacted by a the listing agent or listing office regarding listings you inquire about.  Your information will not be provided to anyone other than the listing office or listing agent by the owner of this website (Washington County Board of REALTORS®).  If you are represented or intend to be represented by a buyer's agent, please make that known immediately upon any communication or inquiry with any other agent.
  6. Property Listing Data: Any real estate listing data provided to you in connection with the Site is not intended to be a representation of the complete Multiple Listing Service data for any of our MLS sources. We are not liable for and do not guarantee the accuracy of any listing data or other data or information found on the Site, and all such information should be independently verified.
  7. Hyperlinks: The Site may contain hyperlinks or framed pages that link to third party web sites. We make no claim or representation regarding the accuracy or content of these sites, and we accept no responsibility for, the quality, content, nature, or reliability of such sites.
  8. Third Party Services: We may advertise products or services of third party individuals or companies on the Site. Your business dealings with any such party is strictly between you and that party, and we are not responsible or liable for the services and/or actions of any such third party. We do not make any assurance as to the timeliness or accuracy of any third-party content or information provided on or linked to from the Site ("Third Party Content"). We do not monitor or have any control over any Third Party Content, and do not endorse or adopt any Third Party Content and can make no guarantee as to its accuracy or completeness. We will not update or review any Third Party Content, and if you choose to use such Third Party Content you do so at your own risk.

Disclaimer: Provider and Site Owner disclaim and makes no warranties or representations, either express or implied, by statute or otherwise, with respect to the Site, including any warranties with respect to quality, accuracy, timeliness, performance, non-infringement, merchantability or fitness for a particular purpose. Provider is not responsible for the content of the listing data submitted to the Site including: the accuracy of the data, any violations of federal fair housing or anti-discrimination laws, false or misleading advertising, or claims that the data may infringe upon the privacy of any U.S. patent, copyright, or other intellectual property right of a third party.
  11. Limitation of Liability: IN NO EVENT SHALL PROVIDER OR SITE OWNER BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE SITE, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE. PROVIDER IS NOT RESPONSIBLE FOR ANY COSTS, INCLUDING, BUT NOT LIMITED TO THOSE INCURRED AS A RESULT OF LOST PROFITS OR REVENUE, LOSS OF ANY SOFTWARE, LOSS OF DATA, THE COST OF RECOVERING SUCH SOFTWARE OR DATA, THE COST OF SUBSTITUTE SOFTWARE, OR CLAIMS BY THIRD PARTIES. YOU ALSO AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS PROVIDER AND SITE OWNER FROM AND AGAINST ANY AND ALL THIRD PARTY CLAIMS, SUITS, LIABILITY, DEMANDS, DAMAGES, COSTS, AND EXPENSES THAT MAY HAVE BEEN CAUSED EITHER DIRECTLY OR INDIRECTLY FROM YOUR USE OF THE SITE.
  12. Applicable Law and Jurisdiction: If any provision in these terms and conditions is held to be legally invalid or unenforceable, then both you and Provider shall be relieved of all obligations arising under such provision, but only to the extent that such provision is invalid or unenforceable, and these terms shall be deemed amended by modifying such provision to the extent necessary to make it valid and enforceable while preserving its intent; or if that is not possible, by substituting another provisions that is valid and enforceable and achieves the same objective and economic result. Any action to enforce a mediation or arbitration award or any injunctive relief sought pursuant to these terms and conditions shall be brought only in the federal or state courts in the state of Utah, and you consent to the exclusive jurisdiction of such courts.
  13. . Modification of Terms: Provider reserves the right to amend these Terms from time to time as needed. You should review these terms frequently. A link to these terms is available at the account login screen.
